Welcome to Anthropos (the “Service”), a cultural AI companion available at anthropos.dev. These Terms of Service (the “Terms”) form a legally binding agreement between you (“you”, “User”) and the operator of Anthropos (the “Operator”, “we”, “us”). By accessing or using the Service you confirm that you have read, understood and accepted these Terms in full. If you do not accept them, you must not use the Service.

1. Nature of the Service — NOT medical, psychological or professional advice

Anthropos is an entertainment, self-reflection and cultural exploration tool powered by artificial intelligence. It is not a medical device, therapist, psychologist, psychiatrist, doctor, lawyer, financial advisor, coach, or any kind of licensed professional. Nothing generated by the Service constitutes medical, psychological, therapeutic, legal, financial, fiscal, spiritual or professional advice, diagnosis or treatment. You must always seek qualified professional help for any physical or mental health concern.

Emergencies: if you or someone else is in danger, having thoughts of self-harm, suicide or violence, or is in a medical emergency, you must immediately call your local emergency number (112 in the EU, 118 in Italy, 911 in the US) or a suicide prevention hotline. Do not rely on the Service in any emergency.

2. Eligibility

You must be at least 16 years old to use the Service. By using it you represent that you meet this age requirement, that you have the legal capacity to enter into these Terms, and that your use complies with all laws applicable to you. The Service is not directed at children under 16 and we do not knowingly collect their data.

3. AI outputs — no guarantees

Responses are generated by large language models and may be inaccurate, incomplete, out of date, biased, offensive or entirely fabricated. We make no representation or warranty about the accuracy, reliability or fitness of any AI output. You are solely responsible for evaluating outputs before acting on them, and for any decisions you make based on them.

4. Acceptable use

You agree not to:

use the Service for unlawful, harmful, harassing, defamatory, discriminatory, violent, sexual (involving minors), or otherwise abusive purposes;
attempt to reverse engineer, scrape, overload, disrupt, or gain unauthorised access to the Service or its infrastructure;
submit personal data of third parties without a valid legal basis;
use the Service to generate content that infringes intellectual property, privacy or other rights;
rely on outputs for medical, legal, financial, safety-critical or high-risk decisions;
impersonate any person or misrepresent your identity, nickname or affiliation.

We may suspend or terminate access at any time, without notice, if we reasonably believe you have violated these Terms.

5. Nickname and account data

The Service uses a unique nickname system stored locally on your device and on our backend to identify returning users. You are responsible for keeping your nickname confidential and for all activity carried out under it.

6. Donations

Donations are voluntary, final and non-refundable and are processed by Stripe. They do not create any obligation, contract, membership, subscription or right to any specific service, feature, response or outcome. No goods, services or tax receipts are provided in exchange for a donation unless expressly stated. Chargebacks made in bad faith may result in termination of access.

7. Intellectual property

The Service, its code, design, branding, texts and archetypes are owned by the Operator and protected by applicable IP laws. You are granted a limited, revocable, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes. You retain rights to the content you input; by submitting it you grant us a worldwide, royalty-free licence to process it solely to operate, secure and improve the Service.

8. Third-party services

The Service relies on third-party providers (including Lovable, Cloudflare, the AI model providers used through the Lovable AI Gateway, Supabase-based infrastructure, and Stripe). We are not responsible for the availability, content or policies of any third-party service.

9. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, security, or uninterrupted operation. We do not warrant that outputs will be safe, correct or suitable for you.

10. Limitation of liability

To the maximum extent permitted by law, the Operator, its affiliates, contributors and providers shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, loss of profits, revenues, data, goodwill, business opportunities, or emotional or psychological harm, arising out of or related to your use of, or inability to use, the Service, even if advised of the possibility of such damages. Our total aggregate liability for any and all claims relating to the Service shall not exceed the greater of (a) the total amount you have donated to Anthropos in the twelve (12) months preceding the event giving rise to the claim, or (b) fifty euro (€50). Nothing in these Terms excludes liability that cannot be excluded under mandatory law (including gross negligence, wilful misconduct or, where applicable, statutory consumer rights).

11. Indemnity

You agree to defend, indemnify and hold harmless the Operator from and against any claims, damages, liabilities, costs and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms or your violation of any law or third-party right.

12. Changes to the Service and to the Terms

We may modify, suspend or discontinue the Service (or any part of it) at any time, with or without notice. We may update these Terms; the “Last updated” date will reflect the change. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing law and jurisdiction

These Terms are governed by the laws of Italy, without regard to conflict-of-laws principles. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts competent for the Operator's place of residence in Italy, save for any non-waivable rights of consumers to bring proceedings in the courts of their country of residence.

14. Miscellaneous

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force. Our failure to enforce any right is not a waiver. These Terms constitute the entire agreement between you and the Operator regarding the Service.
